Letter/Email #3/3 from LCPOA Volunteers

Dear Neighbor and LCPOA Member,

This is our third email to you from the volunteers in our Association. The first focused on the reasons why we strongly endorse Roy Paulson and David Boyd in the upcoming LCPOA Board of Directors election. The second focused on the misrepresentations, distortions, and falsehoods that have been deliberately disseminated by candidates Steve Brown and Michael Ghafouri.

This email attempts to assess the potential impact to our Association, and our way of life in La Cresta, if the Ghafouri/Brown faction gain control of the Board. The picture is not pretty.

While candidates Ghafouri and Brown have put very little in writing on this topic, they have either individually or collectively stated publicly to one or more of our LCPOA volunteers that they plan to:

- Fire our property management company, Powerstone

- Fire our long-standing attorneys, Whitney Petchul

- Dismiss some or all of the volunteers on the Architectural Committee

- Dismiss some or all of the volunteers on the Road Committee

- Dismiss some or all of the volunteers on the Trails Committee

- Dismiss and reconstitute the Governing Documents Committee

- Eliminate the Election Security Committee

- Eliminate the Nominating Committee

Once these actions are taken, how many remaining volunteers will continue to work for a Board that does not value volunteer contribution? The collective impact of these changes will be devastating. Ghafouri and Brown will be able to stack the deck in a way that will take significant expense and many years to recover. We cannot let that happen.

With regard to the three open litigation matters, they will very likely:

- Settle, at potential significant cost to all of us, the litigation involving Gene Prokhorenko

- Dismiss the valid and proper claims that the Association has made against Michael Ghafouri

- Settle, at some cost to all of us, the complaint filed by Steve Brown’s wife

These legal decisions could have a detrimental effect on the ability of LCPOA to get insurance in the future. Given their personal involvement in two of the three cases, there seems to be a clear conflict of interest present.

What happens to our Association if we do not have insurance?

- Each LCPOA property owner could have personal liability for future litigation judgements or settlements, including accidents on our roads or trails

- Judgements against, or defense by, LCPOA could result in special assessments against all members

Can we really afford to be without appropriate insurance?

We also have great concerns regarding our financial reserves. Michael Ghafouri has for many years stated that he believes that we are “over funded” and that either dues should be abated for a year or funds returned to the members. He is completely wrong about this as has been demonstrated by multiple third-party reviews of our financials and our reserves. Nevertheless, in an effort to attract votes, he has perpetuated this falsehood.

What happens when our reserves are reduced below an acceptable level?

- Contractors will not work for us without advance payment for large jobs like road maintenance, trail repairs and drainage facility repairs

- Each LCPOA property owner would be required to pay a special assessment to cover any expense that should have been a reserve item

- Absent a special assessment, each LCPOA property owner would be responsible to pay for road maintenance and drainage repairs along their property lines – if you want to see what this looks like, take a drive on Valle Vista or Calle de Companero after the end of the LCPOA maintained roadway, or on Gabriella Lane.

Taking on financial responsibility for cul-de-sac repairs and maintenance has been dangled by Brown and Ghafouri in an effort to garner votes. Since the current CC&Rs do not permit this, as stated by both our current and past law firms, and as affirmed by a judge in 2020, any use of Association funds to accomplish this will likely attract a lawsuit of epic proportions.

How about fire safety? Ghafouri and Brown had stated the same tired ideas as in the past – none of which have been shown to be viable. They have dismissed the ideas of heli-hydrants by claiming that an adequate water supply is only 4 or 5 minutes away. Imagine watching a helicopter take 8-10 minutes for a round trip to get water while your house is burning. If that time could be cut in half – or better – you would be greatly appreciative. Additionally, increasing the shelter-in-place locations within LCPOA requires insurance that we might not have. Can we really take this risk?

Now that the ballots are out, please complete them and return them to the inspector of elections as directed in the ballot package. Because each lot owner is entitled to three votes, and we only want those votes shared between Roy Paulson and David Boyd, please mark your ballots as follows:

IF THE VOTER HAS AN EVEN BIRTH YEAR: PLEASE CAST TWO VOTES FOR DAVID BOYD AND ONEVOTE FOR ROY PAULSON.

IF THE VOTER HAS AN ODD BIRTH YEAR: PLEASE CAST TWO VOTES FOR ROY PAULSON AND ONEVOTE FOR DAVID BOYD.

We, the day-to-day volunteers in La Cresta, respectfully ask you to join us and vote for Roy Paulson and David Boyd to continue the Board majority leadership that has made this community of La Cresta great!
